Matthew W. Herrington is an experienced attorney who frequently works with DeLong, Caldwell, Bridgers, Fitzpatrick, & Benjamin, LLC, on wage and hour matters. Matthew grew up in the Florida panhandle and has been based in Atlanta since completing his legal studies.
Matthew’s practice focuses primarily on the areas of Employment and Labor Law, FLSA Minimum Wage and Overtime Litigation, Family Medical Leave Act (FMLA) Litigation, Negotiation of Employment and Severance Agreements, and Employee Benefit Disputes (e.g., pensions, group life insurance). He has represented numerous clients—including both employees and employers—in matters relating to minimum wage and overtime underpayment, various forms of illegal retaliation, and employee contract and benefit disputes.
Matthew has extensive experience in tip credit law and misclassification of employees as independent contractors, and he has successfully handled many such cases against Metro Atlanta nightclubs and bars. In addition, Matthew’s experience includes litigation in all of Georgia’s primary trial and appellate federal and state courts.
