Matthew W. Herrington

Matthew W. Herrington is an experienced attorney who frequently works with DeLong, Caldwell, Bridgers, Fitzpatrick, & Benjamin, LLC, on wage and hour matters and other employment matters. Matthew grew up in the Florida panhandle and has been based in Atlanta since completing his legal studies.

Matthew’s practice focuses primarily on the areas of Employment and Labor Law, FLSA Minimum Wage and Overtime Litigation and Family Medical Leave Act (FMLA) Litigation. He also has extensive experience in matters relating to negotiation of employment and severance agreements, employee benefit disputes (e.g., pensions, group life insurance), forced labor and human trafficking, and various forms of illegal retaliation.

Much of Matthew’s career has been dedicated to combating misclassification and tip theft on behalf of nightclub and food service workers. In recent years, Matthew’s focus has grown to include protection of employees from predatory employment contracts seeking to enforce illegal “tuition repayment” provisions. Matthew’s experience includes litigation in all of Georgia’s primary trial and appellate courts, both state and federal.
